Terms of Service

Welcome to TheFastyle. These Terms of Service ("Terms") govern your access to and use of TheFastyle mobile application and services ("Service"), provided by TheFastyle Team ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 14 years old to use the Service. If you are under 18 (or the age of majority in your jurisdiction), you may only use the Service with the consent of your parent or legal guardian.

2. Account Registration

You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your password and for all activities that occur under your account.

We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, not current, or incomplete.

3. Virtual Try-On & AI Services

The Service utilizes Artificial Intelligence (AI) to generate virtual try-on images.

• Input Content: You represent that you own or have the necessary rights to the photos you upload. You must not upload photos of other people without their explicit consent.
• AI Accuracy: The generated images are simulations. We do not guarantee that the virtual fit, color, or texture will exactly match real-world products.
• Generative AI Use Policy:

  Generative AI models help you explore new topics, learn, and create content. You must interact with this system in a responsible, legal, and safe manner. When using the AI features of the Service, you must comply with the following restrictions. Violation of this policy will result in immediate account termination.

  • No Dangerous or Illegal Activities: You may not generate or distribute content that promotes child sexual abuse or exploitation (CSAM); facilitates violent extremism or terrorism; contains non-consensual sexual content or sexually explicit deepfakes; encourages self-harm or suicide; facilitates illegal acts; infringes on the rights of others; or tracks or monitors individuals without consent.
  • No System Abuse: You may not generate or distribute content that facilitates spam, phishing, or malware; abuse or disruption of the Service's infrastructure; or circumvention of safety filters or abuse detection mechanisms.
  • No Explicit, Violent, or Hateful Content: You may not generate or distribute hate speech, discrimination, or incitement of violence; harassment, bullying, intimidation, or abuse; excessively violent or gory content; or sexually explicit content intended for pornographic purposes.
  • No Misinformation or Deception: You may not engage in fraud, scams, or deceptive practices; impersonate others to deceive; generate misleading content in sensitive areas like health, finance, or law; spread disinformation regarding public interest topics; or misrepresent AI-generated content as human-generated to deceive.

4. User Content & Conduct

You retain ownership of the photos and content you upload ("User Content"). By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and display such content solely for the purpose of providing the Service.

4.1 Prohibited Content (Zero Tolerance)

We maintain a zero-tolerance policy against objectionable content and abusive users. You are strictly prohibited from uploading, posting, or generating content that includes:

• Offensive Material: Content that is defamatory, discriminatory, or mean-spirited, including references or commentary about religion, race, sexual orientation, gender, national/ethnic origin, or other targeted groups.
• Pornography and Nudity: Overtly sexual or pornographic material.
• Violence and Harm: Realistic portrayals of people or animals being killed, maimed, tortured, or abused, or content that encourages violence.
• Harassment and Abuse: Bullying, harassment, or intimidation of any individual or group.
• Illegal Content: Content that promotes illegal acts, including drug use, weapons manufacturing, or other criminal activities.

4.2 Moderation and Enforcement

• Monitoring and Removal: We reserve the right to monitor, pre-screen, review, flag, filter, modify, refuse, or remove any User Content from the Service at any time, for any reason, without notice.
• Account Termination: Any user found violating these terms regarding prohibited content will have their account immediately and permanently suspended or banned.
• Reporting and Blocking: The Service provides mechanisms to report inappropriate content and block abusive users. Use the "Report" function to flag content (we will act within 24 hours) or the "Block" function to prevent further interaction.

5. Subscriptions and Virtual Credits

The Service may offer subscriptions or virtual credits ("Credits") for purchase.

• Final Sale: Except as required by applicable law, all purchases are final and non-refundable.
• Expiration: Credits may have an expiration date as specified at the time of purchase.
• Promotional Credits & Rewards: The Service may offer promotional credits, daily check-in rewards, or bonus programs at our discretion. We reserve the right to modify, suspend, or discontinue these programs, including the amount, frequency, and expiry of complimentary credits, at any time with or without prior notice. Promotional programs are not guaranteed benefits of any subscription tier and do not constitute a contractual obligation.

6. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of TheFastyle and its licensors.

7. Privacy

Your use of the Service is also governed by our Privacy Policy. We comply with applicable data protection laws, including PIPL (China), PIPA (Korea), PDPA (Singapore/Thailand/Malaysia), and others.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, whether express or implied, including the warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, TheFastyle shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of the Service.

10. Governing Law

These Terms shall be governed by the laws of the Hong Kong Special Administrative Region (SAR), without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes through the App. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

13. Apple App Store Additional Terms

The following terms apply if you access the Service via an Apple device (iOS/iPadOS):

1. Acknowledgement: These Terms are concluded between you and TheFastyle only, and not with Apple. TheFastyle, not Apple, is solely responsible for the Service and the content thereof.
2. Scope of License: The license granted to you for the Service is limited to a non-transferable license to use the Service on any Apple-branded Products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
3. Maintenance and Support: TheFastyle is solely responsible for providing any maintenance and support services with respect to the Service. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Service.
4. Warranty: TheFastyle is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Service to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Service.
5. Product Claims: TheFastyle, not Apple, is responsible for addressing any claims of you or any third party relating to the Service or your possession and/or use of the Service, including, but not limited to: (i) product liability claims; (ii) any claim that the Service fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
6. Intellectual Property Rights: In the event of any third party claim that the Service or your possession and use of the Service infringes that third party's intellectual property rights, TheFastyle, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
7. Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
8. Third Party Terms of Agreement: You must comply with applicable third party terms of agreement when using the Service (e.g., your wireless data service agreement).
9. Third Party Beneficiary: Apple, and Apple's subsidiaries, are third party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary thereof.
